HSE Asks Employers to Check Employee Credentials after Forklift Accident

The Health and Safety Executive (HSE) has cautioned all employers to diligently verify the qualifications and experience cited by prospective employees. The HSE’s call comes after a forklift truck driver, who had provided fraudulent papers regarding his experience and competency, was fined for his negligence that led to an accident at the workplace.

Livingston Sheriff Court slapped a fine of 500 pounds on Damon Alex McLachlan after he pleaded guilty to breaching Section 7 of the Health and Safety at Work etc Act 1974.

The October 2007 accident occurred at a house construction site in Livingston, West Lothian, where McLachlan was engaged as a telehandler operator. On the day of the mishap, he was unloading parts of a wooden house kit from a lorry using telehandling machinery. However, he had failed to deploy the stabilizers, and as a result of this omission, the forklift dropped a three-ton load on the banksman standing nearby, injuring him grievously.

During the hearing of the case, HSE investigators pointed out that McLachlan had been working on the site only for a few weeks. Further, the experience, qualifications and training he claimed to have were only partly accurate.

Speaking about the case, Bruce Monaghan, an inspector with the HSE, has said that such incidents can be avoided if some minimal precautions are taken at work. Pointing out that the failure of the worker to use the stabilizers had caused the accident, Monaghan stressed that if correct operating instructions are followed, such accidents can be prevented.

Monaghan also reiterated the crucial need for employers to verify the accuracy of claims made by prospective employees. He added that such basic background checks and verifications can ensure that only skilled and competent employees are appointed to operate potentially dangerous equipment like forklift trucks.

Fit Note Unlikely to be Solution to Problems Faced by the Industry

The plan to abandon the sick note and replace it with the fit note has not impressed a law firm, which has warned that such a step would only result in forcing sick employees to return to work prematurely.

Thompsons Solicitors is of the view that the new policy is neither going to reduce sick leave costs incurred by companies nor will it cut down compensation payments made to employees for injuries or sickness caused due to poor workplace conditions.

In the new system of fit notes, GPs will be asked to decide upon the category a patient falls in, like whether a patient is fit for work, unfit for work or fit enough for some sort of work. The patients falling in the third category will be given the option of returning to work with freedom of altered hours of work, performing different kinds of work and seeking workplace acclimatization.

Head of policy at Thompsons Tim Jones, while commenting on the issue, said that the firm is in favour of any reform that can help sick and injured employees get back to work, as many workers are compelled to extend their sick leave just because they are not provided with opportunities to get back to office. He however insisted that the proposed system would not have any discernible effect on this trend of lack of facilities for workers to get back to work. The employees’ dilemma of wanting to work but not being able to do so will persist with the new policy.

Jones went on to predict that in the proposed system, employees might even be forcibly made to resume work without being ready for it and then they might face the axe for not performing well. This approach will be detrimental to both employees as well as employers as it will fail to address the issues of long-term welfare of employees.

A youngster’s fingers were crushed recently when he tried to stop a mini digger from tumbling over and in another incident, an apprentice plasterer in his late teens hurt his eyes and skin, and suffered nerve damage after coming in contact with caustic present in wet plaster.

In one of the cases, a 15 year old teenager Adam Gosling died when a wall fell on his head and caused grave injuries and the builder was charged for manslaughter.

Promotions Have Adverse Impact on Mental Health

Economics and psychology researchers at the University of Warwick have found that promotions may not be as great as they may sound. A recent research conducted by them has showed that promotions result in increased mental strain and leave lesser time to visit a doctor on a regular basis.

The research was carried with about 1,000 workers who in the last five years had been promoted to supervisory or managerial levels. These workers answered queries relating to their health, mental fitness and their use of health services. The analysis of the survey showed no significant improvement in their health after the promotion.

However, the major change that was noticed was in their stress levels. The mental health of these newly promoted workers was found to have declined by 10%. At the same time, visits to doctors fell by 20%. Researchers are of the opinion that this reduction in visits is not due to the improved health of the employees, but due to the increased stress at work associated with their new positions.

One of the researchers, Chris Boyce, said that promotions might not be such good news after all, since they also bring about mental health deterioration that is beyond a short-term change. He said that the lesser number of visits to the doctor was a serious concern as well, since there were no indications of health improvements in the survey participants.
